These Terms apply to all orders placed with Tubmarine Ltd, Unit 1, The Old Sawmills, Middlemarsh, Sherborne, Dorset DT9 5QW, UK. Company registration number: [INSERT COMPANY NUMBER]. Please read them carefully before placing an order. By placing an order with Tubmarine, you agree to these Terms.
Terms of Service
Orders
All orders are subject to acceptance and availability. Once an order is confirmed and production has commenced, it is considered final and cannot be cancelled, except where required by law. We offer the option of a 50% deposit at the time of order, with the remaining balance payable prior to dispatch or installation.
Payment
Payment must be made in full at the time of order, or in accordance with the agreed deposit arrangement. We accept payment by bank transfer. All prices are quoted in pounds sterling and include VAT where applicable. Prices may change from time to time, but confirmed orders are honoured at the price agreed at the time of order.
Deposits
Where a deposit is paid, it secures your build slot and confirms your order. If you cancel before production has commenced, your deposit may be refundable in part or in full at our discretion, less any costs already incurred. Once production has commenced, the deposit is non-refundable except where required by law.
Customisation
Our products are manufactured to order. Any bespoke specifications or custom finishes must be confirmed in writing at the time of order.
Lead times
Estimated lead times are provided at the time of order. While we endeavour to meet all stated lead times, delays may occur due to circumstances beyond our control. Any changes will be communicated promptly.
Delivery and installation
Delivery or installation will be scheduled once the product is complete. Customers are responsible for providing accurate access and delivery information. Additional costs resulting from incorrect or incomplete information may be charged. For orders shipped outside the UK, the customer is responsible for any import duties, taxes, customs clearance and related charges.
Product characteristics
Our products are handmade from stainless steel. While every effort is made to achieve a flawless finish, minor marks or variations may occur and are considered part of the character of a handcrafted product.
Warranty
Our products are supplied with a warranty against defects in materials and workmanship under normal residential use. The 316 stainless steel tub structure and Kebony timber cladding are covered for 10 years; electrical heating systems, pumps, plumbing and electrical components, and the lid and steps are covered for 2 years. The warranty is subject to conditions — including correct installation, appropriate water chemistry and maintenance — and proof of purchase is required for any claim. Full warranty terms are provided with your product and are available on request.
Intellectual property
All designs, branding and intellectual property associated with Tubmarine products remain the property of Tubmarine Ltd.
Liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, for fraud, or for any matter where liability cannot legally be excluded. We are not liable for indirect or consequential losses arising from the use of our products.
Governing law
These Terms, and any dispute arising from them or from your order, are governed by the law of England and Wales, and are subject to the exclusive jurisdiction of the courts of England and Wales.
Returns Policy
At Tubmarine, we specialise in crafting premium stainless steel spa products, each manufactured to order. Because of the bespoke nature of our products, the following returns policy applies.
Made-to-order products
All Tubmarine spa products are manufactured specifically to the customer's order. As such, orders for made-to-order or customised products are exempt from the standard 14-day cooling-off period under the Consumer Contracts Regulations 2013. This exemption is made clear to you before your order is placed. Once production has commenced, orders cannot be cancelled or refunded except where required by law.
Faulty or damaged products
Your statutory rights are not affected. If your product is faulty, damaged or not as described, please contact us as soon as reasonably possible after delivery. We will assess the issue and, where appropriate, offer a repair, replacement or refund in line with your rights under the Consumer Rights Act 2015. We ask that any issues are reported promptly and supported with photographs where possible, to allow us to investigate efficiently.
Damage in transit
Any visible damage should be noted on delivery and reported to us immediately. Concealed damage should be reported as soon as it becomes apparent.
